Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards associated with not wearing a seat belt when exposed to the hazard of driving a forklift off a loading dock: Loading Dock: On or about July 8, 2011, the employer did not ensure that the operator of a Nissan 40 Forklift was using the seat belt of the forklift. The employee and the forklift fell over the edge of the loading dock and the employee received arm and back injuries. Methods of abatement include: 1) Train operators of forklifts to wear seatbelts. 2) Conduct periodic inspections to ensure that operators of forklifts are wearing seat belts. 3) Institute a disciplinary program for violations of seatbelt rules.
