Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards associated with falls when doing roofing work
during adverse
weather conditions.
At the site on the penthouse roof:  Workers were performing roofing work
along the edge of a
roof that was 20 feet above the next lower level during windy conditions
and were not protected
from falling.  Although a monitoring sysem was in place additional fall
protection measures were
required due to windy conditions to protect the employees.
Several feasible and acceptable means of abatement would be:
1.  Utilize a personal fall arrest system when performing roofing work in
adverse
weather
conditions.
2.  Delay work until the wind subsides
3.  Install the wood nailer while working from a ladder
4.  Establish an anchor point on the roof and have workers wear a harness
and lanyard
