Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: an employee was exposed to struck-by and caught between injuries from the rotating superstructure of the excavator. Jobsite: The laborer was exposed to struck-by and caught between injuries while standing near the rear of the excavator as it excavated the building slab and loaded debris onto a dump truck. Among feasible abatement methods are preventing employees from entering the danger zone using barricades or other physical barriers; and ensuring that employees are trained in barrier erection and use and procedures for, and conditions under which, employees can enter the danger zone.r
