North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: a)west bulk loading room, no methods were used to control the escape of fugitive combustible dust during the loading of trucks. b)east bulk loading room, no methods were used to control the escape of fugitive combustible dust during the loading of trucks. c)grinding room, the internal and external bucket elevators did not have explosion protection, such as but not limited to deflagration venting and isolation protection. d)grinding room, the enclosed conveyor systems did not have isolation protection devices to prevent deflagration into the cake processing area. e)storage silos, the five exterior storage silos were not provided with explosion protection, such as but not limited to deflagration venting and isolation protection. Among other methods, feasible and acceptable methods to abate these hazards is to comply with national Fire Protection agency (NFPA) 654, "Standard for the Prevention of Fires and Explosions from the Manufacturing, Processing and handling of Combustible Particulate Solids" (2006) Note: The design of fire and explosion safety provisions shall be based on a thorough process hazard analysis of the facility, the process and the associated fire and explosion hazards.
