Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about January 21, 2011, at the above addressed jobsite, an employee was exposed to fall hazards in that an operator was not present to operate the controls and/or the platform was not equipped with controls. One feasible and acceptable abatement method, among others, would be to comply with the owner/operators manual, which states, "A trained operator must operate the controls from the operators compartment and must remain with the vehicle at all times." b. On or about January 21, 2011, at the above addressed jobsite, employees were exposed to fall hazards in that they did not keep their feet on the floor of the platform and climbed from the platform. One feasible and acceptable abatement method, among others, would be to comply with the owner/operators manual, which states, "Personal aboard the work platform must maintain a firm footing at all times. The platform shall be lowered to ground level for personnel to enter or exit the platform through the appropriate platform access opening. Personnel must not climb on any part of the vehicle or over the platform guardrails in an attempt to enter or exit the platform."
