Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) On or about January 6, 2011, at the above addressed jobsite, an employee was exposed to falls while standing on the toprail of a Sky Jack Scissors lift Model 400. One feasible and acceptable abatement method, among others, would be to comply with ANSI/SIA A92.6-1999 Standard for Self-Propelled Elevating Work Platforms, which states "Personnel shall maintain a firm footing on the platform floor while working thereon."
