Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about April 7, 2011, at the above addressed jobsite, an employee was exposed to falls while standing on the elevated forks of a Genie GTH-1048 rough terrain forklift to access the work area. One feasible and acceptable abatement method, among others, would be to comply with AMSE/ANSI B56.6 - 2002 Safety Standards for Rough Terrain Fork Trucks, which states "A rough terrain forklift truck shall not be used to lift people unless there is no other practical option." b. On or about April 7, 2011, at the above addressed jobsite, employees were exposed to falls while standing on a pallet which was elevated by a Genie GTH-1048 rough terrain forklift to access the work area.
