Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about May 6, 2011, at the above addressed jobsite, an employee working from a platform (plywood) set on the forks of a Caterpillar TH83 rough terrain fork truck was exposed to fall and struck by hazards associated with an elevated rough terrain forklift being left unattended in that an operator was not present to operate the controls and the platform was not equipped with controls. One feasilble and acceptable means of abatement would be to comply with the ASME/ANSI B56.6-2002 Safety Standard for Rough Terrain forklift trucks, which requires a trained operator to be in position to control the rough terrain forklift truck.ft
