Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about May 18, 2011, in the warehouse at the above site address employees worked at heights of 12 feet above ground level from a makeshift basket which was supported by the forks of a powered industrial truck in order to install racking system crossmembers. The employer failed to implement adequate safety procedures for lifting personnel, thereby employees were exposed to crushing and falls hazards. Among other methods, feasible and acceptable abatement methods include following the requirements for lifting personnel explained in section 7.37 Platforms: Elevating of the ANSI/ASME B56.1-2000 Safety Standard for Low and High Lift Trucks.
