Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about May 17, 2011, at the above addressed jobsite, employees were exposed to falls while standing on a pallet which was elevated by a GEHL 663 rough terrain forklift to access the work area. One feasible and acceptable method, among others, would be to comply with AMSE/ANSI B56.6 - 2002 Safety Standards for Rough Terrain Fork Trucks, which states, "A rough terrain forklift shall not be used to lift people unless there is no other practical option."l
