5.2.13 NMAC
Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety
Act):  The
employer did not furnish each of his employees employment and a place of
employment which
were free from recognized hazards that were causing or were likely to
cause death or serious
physical harm to his employees.
Employees in the production areas of the facility (MRB and Swiss Turn
Operation Department)
were exposed to the hazards associated with the use of 40 PVC pipe for the
delivery of
compressed air.  The mode of failure for this type of piping is explosion
with sharp projectiles
which may result in serious injuries including severe lacerations.
Use of Schedule 40 PVC is a recognized hazard as addressed by:  Sections
842.32 and 949.52(a)
of the American National Standards Institute and American Society of
Mechanical Engineers
(ANSI/ASME) Standards B31.8-1986, Gas Transmission and Distribution Piping
Systems
Standard; American Society of Testing Materials (ASTM) D1785-86, Standard
Specifications
for Polyvinyl Chloride Plastic Pipe, Schedules 40, 80, and 120; and ASTM
D2513-86a, Standard
Specification for Thermo plastic Gas Pressure Piping Systems.
Among others, feasible and acceptable methods of abatement include
replacing PVC with metal
piping or properly tested non-PVC materials, or encasing the piping in
steel, cement or other
material which would create an effective barrier in the event of pipe
failure.
