Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burn hazard: a) Work Site - Shop Rite Store #247, 428 S. Livingston Avenue, Livingston, NJ: Employee cleaning industrial ventilation hood, while standing on a metal tray placed on top of a Henny Penny deep fryer containing hot oil, was burned when the plate moved and his foot submerged into the heated oil. Violation occurred on or about 1/13/2011. Abatement Note: Among other feasible methods, methods to correct this hazard include: 1) Prohibit employees from standing on top of deep fryers. 2) Provide safe access, including the use of ladders, to employees required to clean industrial hoods. 3) Train employees in the safe and proper methods to clean industrial kitchen hoods, as well as the hazards associated with working above and around deep fryers containing hot oil. 4) Comply with NFPA 96, Standard for Ventilation Control and Fire Protection of Commercial Cooking Operations, 2001 Edition,"Chapter 11.4: Cleaning of Exhaust Systems".
