Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to falls from improper installation and use of step ladders: On 1 December 2010, and other times prior thereto, at and near Acuair #3, employees climbed a Werner, 10-foot, fiberglass step ladder to gain access to shut off valves of engine room #1. The step ladder was installed and used with the following hazardous conditions: a.The step ladder was mounted on "S" shaped hooks. b.The step ladder was not mounted in a manner to prevent swaying or movement. c.The step ladder did not extend 36 inches above the upper landing surface nor was there a grab bar to assist in the mounting and dismounting of the ladder. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a fixed ladder in accordance with the requirements of American National Standards Institute A14.5.
