Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)McDonald's, Tyrone Boulevard St. Petersburg - An Altec digger derrick had not had a comprehensive periodic inspection in the prior twelve months, on or about November 15, 2010. b)McDonald's, Tyrone Boulevard St. Petersburg - Operating and service manuals were not available for an Altec digger derrick, on or about November 15, 2010. Among other methods, one feasible and acceptable abatement method to correct these hazards is to ensure that the digger derrick has a comprehensive inspection every twelve months and provide the required manuals in accordance with ANSI/ASSE A10.31-2006 Safety Requirements, Definitions and Specifications for Digger Derricks.tions
