Section 5 (a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were being exposed to struck by a payloader that did not have
properly operating
brakes.
a) At the work site - 135 Pine Aire Drive, Bay Shore, NY - The brakes of
the front End
Payloader (Komatsu / Dresser - Model #520 Serial #36000/C006116*) were not
operating
properly. The rear view & side view mirrors as well as the front & rear
lights were missing
while the loader remained in service; on or about 2/7/11.
ABATEMENT NOTES:
Among other methods, feasible and acceptable methods to correct the
hazards include but are
not limited to:
- Ensuring that all required safery features, including safety signs, are
operational and
functioning, and repairing, prior to placing equipment into service, any
reported malfunction
or defect that affects the safe operation of the equipment; as per the
Environmental Industry
Associations for Mobile Equipment Technology and Operations for Wastes and
Recyclable
Materials ANSI Z245.1 - 2008, 6.1.5  (see Appendix A).
- Assigning only trained employees to work on (which includes driving,
operating, loading,
cleaning, servicing, maintaining, or repairing) equipment which is subject
to the provisions
of this standard; as per the Environmental Industry Associations for
Mobile Equipment
Technology and Operations for Wastes and Recyclable Materials ANSI Z245.1
- 2008, 6.1.3
(see Appendix B).
Note:  In addition to abatement certification, the employer is required to
submit
abatement documentation for this item in accordance with 29 CFR 1903.19.
