Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to being struck by a Front End Loader:
a) Worksite, Paragon Recycling - The backup alarm was in disrepair and not
functioning as
intended on a Caterpillar IT28B, Front End Loader with bucket attached.
The employer did
not ensure that vehicle had a working backup alarm, exposing employees to
the hazard of
being run over by the equipment; on, or about, 02/08/11.
Abatement Note:
Among other methods, one feasible and acceptable abatement method to
correct this
hazard would be to comply with the manufacturer's Operation & Maintenance
Manual
for Caterpillar IT28B Integrated Toolcarriers. In the "Preparing to
Operate
the
Machine" section of the manual on page 9, it indicates to check safety
equipment,
such as back up alarms, and ensure that these items are securely in place
and in
operating condition.
Note: In addition to abatement certification, the employer is required to
submit
abatement documentation for this item in accordance with 29 CFR 1903.19.ce
