Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to tuberculosis:
a) Establishment - Employees including, but not limited to nurses,
physical therapists,
respiratory therapists, occupational therapists, speech therapists,
radiologists,
environmental services personnel, cafeteria workers, and plant operations
personnel did
not receive pre-employment tuberculin skin tests as required by the
Centers for Disease
Control. Approximately 12 of 348 employees required to be tested prior to
employment
were not tested. On or about 2/14/11.
b) Establishment - Employees including, but not limited to nurses,
physical therapists,
respiratory therapists, occupational therapists, speech therapists,
radiologists, case
managers, admitting/registration personnel, nursing administrators,
environmental
services personnel, cafeteria workers, administrators, and plant
operations personnel did
not receive annual  tuberculin skin tests as required by the Centers for
Disease Control.
Approximately 166 of 348 employees required to be tested annually were not
tested. On
or about 2/14/11.
Feasible and useful abatement methods for reducing this hazard as
recommended
by the Centers for Disease Control, among others, are:
Provide medical surveillance (at no cost to employees) including the
required
administration and interpretation of tuberculin skin tests. The frequency
of the tests must
be in accordance with the CDC guidelines.
NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER
IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS
ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY
OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
