Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to moving machine parts while operating a foot operated machine without a foot pedal guard: (a)Press Break Area: An instance of this violation was most recently observed on February 24, 2011, where employees were exposed to unintended operation of a Press Brake, no s/n, due to an unguarded foot pedal. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method is that the employer must guard/protect the foot operated control device to prevent inadvertent operation of the machine due to falling or moving objects making contact with from unintended operation by accidentally stepping onto the foot control. ABATEMENT CERTIFICATION REQUIRED FOR THIS ITEM
