Labor and Employment Article, Section 5-104 (a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:On or About 02/15/11 Location:Scrap Yard Equipment:Liebherr R 944C Crawler Excavator with Sheer Attachment Condition:An employee was exposed to struck-by hazards while performing shearing operations utilizing an excavator that lacked protection from flying debris. Among other methods, one feasible and acceptable abatement method to correct this hazard is to place a cage guard on the windshield of the operator's cab. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
