Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: (a) An employee was exposed to a fall hazard due to working on a work platform that extended more than 10 inches outside the front load bearing tires at 3911 20th Avenue South in Fargo, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 312401284, Citation Number 1, Item Number 1A, and was affirmed as a final order on November 25, 2008, with respect to a workplace located at 4402 Second Avenue SW, Fargo, ND. Among other methods, one feasible and acceptable method to correct this hazard would be to follow the American National Standards Institute B56.6-2005 Safety Standard for Rough Terrain Forklift Trucks, section 8.24.1(b) for platform dimensions.
