Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by metal racks and tires in the event of collapse: (a) Location - Tire storage room: On or about 2/3/11, the employer failed to ensure all metal rack columns were anchored to the floor. Among other methods, on feasible and acceptable method to correct this hazard would be to adhere to the Rack Manufacturers Institute and ANSI MH16.1: 2008 "Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks", Section 1.4.7 which requires that columns be furnished with base plates and be anchored to the floor with anchor bolts capable of resisting the forces caused by the horizontal and vertical loads on the rack.
