Section 5(a)(1) of the OSH Act:  The employer did not furnish to each of
his employees
employment and a place of employment which are free from recognized
hazards that are
causing or are likely to cause death or serious physical harm in that
employees were exposed
to fall and struckby hazards:
a) in that the employer used the bucket of the Caterpillar 320D excavator
to
remove the employees from the excavation.  This practice is in violation
of the
manufacturer's instructions.  The manual states, "Do not allow riders on
the
machine unless the machine has an additional seat with a seat belt."
Employees could fall from the bucket or be struck by the bucket during its
movement.
Means of feasible abatement include: Following the Operation and
Maintenance Manual for
the 320D RR and 320D LRR Excavator: "riding on the bucket is not allowed";
"Make sure
that no personnel will be endangered before you move the machine".
