Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: employees were exposed to struck-by and crushing hazard. (a)Cotton Loading Area - On or about October 12, 2011 an employee was exposed to struck-by and crushing hazards from being ejected while operating a Yale 50 forklift and struck by the roll over protective structure. The employee was not protected by wearing the seatbelt available on the forklift. Among others, one feasible and acceptable method to correct these hazards, is to utilize the installed restraint system in accordance with the current version of American National Standards Institute (ANSI) B56.1, "Safety Standard for Powered Industrial Trucks," and Industrial Truck Standards Development Foundation (ITSDF) B56.1-2005, "Safety Standard for Low Lift and High Lift Trucks."
