Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: (a)Aisle near Shipping Area - On or about October 31, 2011 an employee was exposed to struck-by hazards from the vehicle's rollover protective structure while driving a Toyota forklift. Employee was not protected by wearing a seatbelt in the event of a forklift tipover. Among other methods, one feasible and acceptable method to correct this hazard is to utilize the installed restraint system in accordance with the current version of American National Standards Institute (ANSI) B56.1 - 2005, "Safety Standard for Powered Industrial Trucks".
