Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to the hazard of falling from the bucket of an excavator: (a)Jobsite - On or about November 07, 2011 employee rode the bucket of a Doosan excavator (model DX140LC) out of a collapsing trench. Among other methods, one feasible and acceptable method to correct this hazard would be to follow the requirement of the DOOSAN DX140LC, operation and maintenance manual, page 1-36, "Never let anyone ride on any work attachment, such as the bucket, crusher, grapple, or clamshell (grab bucket). There is a danger of the person falling and suffering serious injury."
