Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: An employee was exposed to a crush hazard by riding on the fender of Case 570MXT Loader/Landscaper. (a)7th Street & W.31st Ave., Hattiesburg MS - On or about November 15, 2011 an employee was observed riding on the fender of a Case 570MXT Loader/Landscaper. Among other methods, one feasible and acceptable abatement method to correct the hazard included but not limited to: 1. Prohibit rider(s) other than the operator from riding on the Case 570MXT Loader/Landscaper.
