Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: The passenger seat of a motor vehicle used to transport employees was not anchored to prevent movement in the event of a crash and the passenger seat did not have a seat belt. a) GreenForest Nursery, Inc., 1478 Old Hwy 26, Perkinston MS - On or about February 1, 2012 the passenger seat of a Ford E350, XL Super Duty, 15-passenger van was not anchored to prevent movement in the event of a crash and a seat belt was not available. Among other methods, one feasible and acceptable method to correct this hazard is to place the seat in the manufacturer original location and anchor the seat to the floor of the van according to the manufacturer instructions and install a seat belt.
