Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health
Act of 1970:  The
employer did not furnish each of his employees conditions of employment
and a place of
employment free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees, in that, employees were exposed to struck by
or crush by hazard
while operating a forklift without a seatbelt.
(a)Jobsite - On or about March 09, 2012 employees were operating a Datsun
5000
LP forklift, Model No. CPF02A25V, Serial Number CPF02-004584 equipped with
a roll
over protection system (ROPS) without a seatbelt.
Among other methods, one feasible and acceptable method to correct this
hazard would be to
install seatbelt and to follow the F01/F02 Restraint System Installation
Manual LPGAS provided
by Nissan Forklift Corporation, P/N:99900-FP116, KIT No.: 65000-F9016.
