Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazards of crushing and struck-by from falling automotive vehicles: Service Center: 1.The automotive lifts in the following bays had the deficiencies listed as follows: A.Bay 12: Defective safety latches/locks and no label stating the maximum rated capacity. B. Bay 11: Defective safety latches/locks and no label stating the maximum rated capacity. C,Bay 10: Defective safety latches/locks and no label stating the maximum rated capacity. D.Bay 8: Defective safety latches/locks and no label stating the maximum rated capacity. E.Bay 7: No label stating the maximum rated capacity. F.Bay 6: Defective safety latches/locks and no label stating the maximum rated capacity. G.Bay 4: No label stating the maximum rated capacity. 2.The employees/mechanics were allowed to work under and/or in close proximity of the automotive vehicles being lifted prior to the safety latches/locks safely engaged in positions. 3.The employer did not provide employees/mechanics with appropriate and detailed information and training pertaining to the hazards associated with "automotive lifts". Pep Boys, Dba Mangy, Mae & Jack was previously cited for these violations dealing with the same hazards invoking the Section 5(a)(1) of the Occupational Safety and Health Act of 1970, which was contained in OSHA Inspection Number 307919837, Citation Number 01, Item Number 001, issued on August 2, 2006 with respect to a workplace located at Route 6 Scranton Carbondale Highway, Dickson City, PA, and became a final order on August 23, 2006. Among other methods, one feasible and acceptable means of abatement is to: 1.Comply with the requirements of ANSI/ALI Aloim-2000, Standard for Automotive Lift Safety Requirements for Operation, Inspection and Maintenance and the Automotive Lift Institute "Lifting it Right" which states: 2.Comply with the manufacturer's recommendations and the Owner's manual. 3.Instal appropriate labels/tags per the manufacture's specifications. 4.Conduct frequent and periodic inspections and maintenances and keep the most recent records. 5.Provide employees/mechanics with pertinent information and Training. 6.Utilize other engineering technologies and feasibility.
