Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards: a) On or about 3/7/11 in the Press Brake area; opening on press brake # 1 ( Cincinnati model #50577, 90 ton capacity) was set at 1.25" with operator's fingers being as close as three inches away from point of operation while braking this part. Given the size of this part the opening between the die and the bed could have been closed to 0.5" b) On or about 3/18/11 in the Press Brake area; opening on press brake # 2 ( Amada RG80 type D-9 serial # 50805886 ) was set a 7/8" with the operator's thumb being as close as 3.375" away from the point of operation while braking part. Given the size of this part the opening between the die and the bed could have been closed to .25". c) On or about 3/7/11 in the Press Brake area; employer has adopted the " safe distance" guarding method but has not conducted annual inspections with each press brake operator. ABATEMENT CERTIFICATION REQUIRED
