Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.On or about 2/11/2011, at the maintenance shop, All Steel and Gypsum Products Inc., Fort Lauderdale, FL. An employee was exposed to caught and struck by hazards while using a drill press (Delta, Serial Number R9450) that lacked a provision to prevent automatic restart upon restoration of power following a power failure. Among the feasible methods to abate this condition is installing a magnetic switch to prevent restart of the machine upon restoration of power following a power failure.
