Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and caught-in-between hazards: On or about 2/23/2011, at a facility located at 6015 NW 87th Avenue, Miami, Florida, the employer did not follow the manufacturer's recommendation of prohibiting employees from standing on a pallet while being lifted to an elevated level while standing on a pallet attached to the forks of the powered industrial truck. Among other methods, one feasible and acceptable means of abatement would be to follow the manufacturer's recommendation of not allowing personnel to ride on the power industrial truck. NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
