Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and caught-in-between hazards: On or about 2/28/2011, at a facility located at 3273 NW North River Drive, Miami, Florida, the employer did not ensure forklift operators were using the seatbelt at all times. Among other methods, one feasible and acceptable means of abatement would be to follow the manufacturer's recommendation of using the seat belt as referenced by the American Society of Mechanical Engineers/American National Standards Institute, ASME/ANSI B56.1 NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
