Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.On or about 3/9/2011, at the shop area, Estes Express Lines, Miami, FL. An employee was exposed to caught and struck by hazards while working with a drill press (Delta, Model No. 17-965) that lacked a provision for preventing automatic restart upon restoration of power. Among the feasible methods of abatement is to install a magnetic switch to prevent automatic restart upon restoration of power following a power failure.g
