Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 03/10/11, at a traffic intersection of Washingtonian Avenue and Ocean Drive, employee who lacked high visibility apparel was exposed to the hazards of being struck by and/or run over by moving vehicles while directing traffic. Among other methods of abatement, one feasible and acceptable method to correct this hazard is to provide high visibility apparel to employees who are conducting traffic.
