Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm in that employees were exposed to crushing hazards:
On or about June 11, 2011, in 1640 S. Congress Avenue, Boyton Beach,
Florida, employees
working underneath automotive lifts were exposed to crushing hazards at
the following locations:
a) Service bay 1,rotary lift, model FP46A-45FC, the manufacturer's rated
capacity was not
posted on the equipment.
b) Service bay 2, electrical lift, the manufacturer's rated capacity was
not posted on the
equipment.
c) Service bay 3, rotary lift, model FP46A-45FC, jack stands were not used
under the lift and
locking device was not engaged when an employee worked under the lift.
d) Service bay 4, rotary lift, model FP46A-45FC, was not locked and/or
tagged when it was
known to be out of service.
e) Service bay 5, rotary lift model DT028H MK VI, was not locked and/or
tagged when it was
known to be out of service.
f) Service bay 6, rotary lift, model FP46A-45FC, locking device was dirty
and not functioning.
g) Service bay 7, rotary lift model DT028H MK VI, was not locked and/or
tagged when it was
know to be out of service.
h) Service bay 8, rotary lift model DT028H MK VI, the manufacturer's rated
capacity was not
posted on the equipment.
Among other methods, one feasible and acceptable means of abatement is to
ensure compliance
with the operator's manual for each lift by ensuring adequate maintenance
and inspection of the
equipment and prohibiting workers from operating lifts without receiving
training in accordance
with the operator's manual prior to operation.
