Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to kick back, struck-by and cut hazards while using a Stihl Saw Model TS 420 to cut an unsupported work piece. On or about 06/24/11, at the 1100 block of 10th Street Miami Beach, FL. The employees working inside an excavation were exposed to kick back, struck-by, and cut hazards when operating a saw to cut a ductile iron pipe without supporting the pipe in a way that would prevent the saw blade from being pinched. Among other methods of abatement, one feasible and acceptable method to correct these hazards is to prevent the saw blade from being pinched and subsequent tool kick back by supporting the pieces/sections being cut in a way that the cut remains open during and after such cut is completed. PLEASE NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
