Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing hazards:
a) 1325 Highway 34, Farmingdale, NJ 07727: On or about March 24, 2011, the
employer failed
to train employees on the crushing hazards associated with operating
scissor lifts. An employee
was injured after being crushed between a moving Pinguely-Haulotte Scissor
Lift and a fixed
scissor lift.
AMONG OTHER MEANS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT
THIS HAZARD WOULD BE FOR THE COMPANY TO:
Document and provide training to employees on the hazards associated with
operating aerial lifts.
Training shall include, but not necessarily be limited to, the following
issues and requirements:
1) The purpose and use of manuals.
2) That operating manuals are an integral part of the aerial platform and
must be stored
properly in the weather resistant compartment when not in use.
3) A pre-start inspection.
4) Factors affecting stability.
5) The purpose of placards and decals.
6) Workplace inspection.
7) Safety rules and regulations.
8) Authorization to operate.
9) Operator warnings and instructions.
10) Actual operation of the aerial platform. Under the direction of a
qualified person, the
trainee shall operate the aerial platform for a sufficient period of time
to demonstrated
proficiency in the actual operation of the aerial platform.
NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION
FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL
PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.CE
