Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to fall hazards: At this location, employees are not protected from falls when climbing on hopper rail cars, measuring approximately 13 feet in height, to sample and inspect grain for infestation of insects and for foreign debris. An acceptable means of abatement would be to develop and implement a method to provide fall protection, such as, but not limited to, a personal fall arrest system.
