Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employee were exposed to a fall hazard in the workplace.
a) At the worksite, Yard of 2325 County Road 104, East Quogue, NY: On May
27, 2011,
An employee was lifted by a forklift (Combilift Model #C120100LA53) while
standing on
pieces of stack lumber that were used as platform on the raised forks.
There were no
guardrails or personal fall arrest systems in use. The employee was lifted
to a height of
approximately 7'3 ft above ground; on or about 6/1/11.
ABATEMENT NOTES:
Among other methods, feasible and acceptable methods to correct the
hazards include but are
not limited to:
1.) Instruct employees to utilize only approved platforms equipped with
guardrails, which can
be securely attached to the forks of the powered industrial truck in
accordance with AMSE
B56.1-2000, Section 7.36.1 Platforms - Elevating.
2.) Train employees about the hazard of falls associated with improper
elevating methods.
3.) Ensure that employees exposed to fall hazards are protected from
falling by using
personal fall arrest systems.
Note: In addition to abatement certification, the employer is required to
submit
abatement documentation for this item in accordance with 29 CFR 1903.19.
