Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)Faga'alu Village Road - On 10 March 2011 and at times prior thereto,
the workers were
observed working and walking near the excavator which was being used to
move rocks and dirt
on the two lane gravel road. Regular rebars were modified as pins for the
bucket or the shovel
of the excavator instead of pins originally provided by the manufacturer,
to secure the bucket.
Slippage of the coupling could result in unintended separation of the
bucket during operation,
potentially striking or injuring the workers.
Among other methods to abate the hazard was to secure the proper pin for
the working bucket
or to use another equipment with the proper pin. They could also delay the
job
while ordering
a new pin from the manufacturer.
