North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed struck by and caught in hazards. a)Loading dock - The "Nissan 30 Series" straight mast, solid tire, battery powered, forklift model type #KPHH02A20PV and SSN #CULO1L15S with the roll over protection system was not equipped with a operator restraint system such as cab enclosure ,or seat belt. Abatement note: One means of abatement would be to purchase and mount a seat belt on all equipment with roll over protection devices according to the manufacturer's requirements.s
