North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a descending automobile hydraulic lift: a.site-hydraulic operating handle for a Rotary vehicle lift, had a broken spring which allowed the device to lower without an operator at the controls and allow the device to descend onto an employee. Ref: para 7.1.2 ANSI B153.1-1990. b.site-the operating instructions for the Rotary vehicle lift, used to raise and lower vehicles for maintenance, were not posted in a conspicuous location in the lift area which could allow misuse of the equipment resulting in serious injury. Ref para 7.2.1 ANSI B153.1-1990.
