North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)job site - 1 employee was working under and in near proximity to a suspended load while removing concrete beams from an underground vault. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is to establish safe operating rules which would not allow employees to be under, adjacent to, or near (in the danger area) the load during lifting operations.
