North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)site - where two employees were working in the middle of the road trying to slow down traffic without the use of temporary traffic control devices such as, but not limited to, cones and signs. Abatement Note: One feasible and acceptable abatement method, among others, to correct this hazard is to install high visibility cones and traffic signs to alter vehicle traffic away from the work area. (Reference: Part VI of the manual on Uniform Traffic Control Devices (MUTCD) 2003 Edition on the MUTCD, Revision 1, June 1, 2006)
