North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from vehicular traffic: a)facility, wastewater - employees preparing tankers for loading were in the path of semi-tanker trucks backing into the loading area or from the unexpected movement, in any direction, of the tanker truck. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is to require an observer or spotter to safely direct semi-tanker trucks being backed into the loading area. Develop and implement procedures for employees serving as spotters for drivers, to include where they will stand and how they will communicate with drivers (e.g., verbal, hand signals, flags, etc.) 2)Among other methods, one feasible and acceptable abatement method to correct these hazards is to develop and implement a program to ensure any movement by tanker trucks only be made under the positive control of Smithfield Packing Company employees. This program may include such items as tanker key control, wheel locking devices.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: fall from height and struck by vehicular traffic: a)wastewater facility, loading area - where the employer failed to provide adequate lighting in the loading area for employees who access the top of semi-tanker trailers to unload sludge from the overhead storage tanks, where the lighting ranged from 0.01 - 2.6 foot candles. b)main facility, yard - where the employer failed to provide adequate lighting in the rear of the building where employees who walked between the plant and rendering and casings buildings were exposed to vehicular traffic, and the lighting ranged from 0.01 - 2.6 foot candles. Reference:American National Standard Practice for Industrial Lighting Standard (ANSI), (A11.1-1965), table 1, pages 10-11. Feasible abatement methods, among others, to correct this hazard are, but not limited to: a)Install additional fixed lighting to provide adequate lighting in accordance with ANSI. 1.building exterior, pedestrian minimum requirement of 5 foot candles. 2.building exterior, catwalks minimum requirement of 2 foot candles. 3.building exterior, material handling minimum requirement of 20 foot candles. 4.building exterior, roadways between or along buildings minimum requirement of 1 foot candle. b)Ensure a regular scheduled system of maintenance to clean the lights.
