Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to struck against hazards:
a)Facility Yard - "Volvo" front end loaders, model L90E, were used to
sort, load, and move
mulch and/or shavings throughout the yard area of the facility with
employees not always
wearing the factory installed seatbelt as recommended in the operators
manual.
One feasible method of abatement would be to require and enforce the use
of the seatbelt as recommended in
the operators manual.  Company safety policy should also reflect that
operators be required to wear their
seatbelt.
