Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazard: a)East side of warehouse: On or about April 15, 2011, the employer exposed employees to struck-by hazards, in that a set of shelves were not maintained by the owner, such as inspecting for damage when employees are working in the area, unloading, or loading tents onto shelves. b)Northeast side of warehouse: On or about April 15, 2011, the employer exposed employees to struck-by hazards in that shelving was not anchored to the floor, such as with a base plate and anchor bolts. c)East side of warehouse: On or about April 15, 2011, the employer exposed employees to struck-by hazards in that shelving was not anchored to the floor, such as with a base plate and anchor bolts. d)Center of warehouse storage area: On or about April 15, 2011, the employer exposed employees to struck-by hazards in that shelving was not inspected or anchored to floor, such as ensuring integrity of columns and securing with base plates and anchor bolts. Among others, one feasible and acceptable method to correct the hazards is to follow the standards in ANSI MH16.1, sections 1.4.1, Owner Maintenance, and 1.4.7, Columns Base Plates and Anchors.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from operating a forklift without wearing the equipped seat belt: a)Warehouse: On or about April 15, 2011, the employer exposed employees to struck-by and crushing hazards in that they failed to ensure the forklift operator wore the seat belt when operating the Hyster XMS 40 forklift to load and unload rental equipment and supplies. Among others, one feasible and acceptable method to correct the hazards is to follow the standards in ANSI B56.1-2000.
