Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being stuck-by or thrown from a powered industrial truck hazards: a)Polymer mixing area: On or about May 26, 2011, the employer exposed employees to in that they failed to ensure forklift operators wore the equipped seat belt when operating the Yale forklift, SN#B875B05257D, when transporting and mixing 1980lb bag of Kraton D. b)Packaging area: On or about May 26, 2011, the employer exposed employees to struck-by or thrown from hazards in that they failed to ensure forklift operators wore the equipped seat belt when operating the Yale forklift, SN#B875B05270D, when c)Southeast tank area: On or about May 26, 2011, the employer exposed employees to struck-by or thrown from hazards in that they failed to ensure backhoe operators wore the equipped seat belt on a heavily damaged seat when operating John Deere backhoe, model 310E. d)Near maintenance shop: On or about May 26, 2011, the employer exposed employees to struck-by or thrown from hazards in that they failed to ensure Ingersoll Rad Lull VR10569, operators wore equipped seat belt when operating. Among others, one feasible and acceptable method to correct the hazards is to train employees to utilize seat belts, as referenced in ANSI B56.1-2000, and enforece the usage. For instance (c) seat, a feasible and acceptable method would be to install a new seat.
