Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to a struck-by hazard: On or about May 26, 2011, and at other times prior thereto, in the east yard and the west yard, employees were not protected against a struck-by hazard during yard watering operations using a Euclid water truck, Number S-617 without a back-up alarm. Among other methods, one feasible and acceptable abatement method would be installation of a functional back-up alarm.
